Australia is a great place to be in. It’s a country with a strong economy and abundant possibilities for foreigners to work and study. Here, we will look at what it takes to obtain an Australia PR visa. We will see what's necessary for you to be eligible to apply for permanent residence in Australia.

There are many Australian migrant visas that can enable you to live and work in Australia permanently. So, understanding the eligibility would need us to discuss some of the most popular of those visa categories.

Family-based PR

This pathway is for those who already have a relative as an Australian citizen or Australia PR visa holder. They can immigrate to Canada if they are sponsored by those in Australia.

Here’s how you can be eligible for several family-based visa options to immigrate to Australia:

Subclass 820 & 801 (Partner Visa)

In this pathway, the relative will first get a Subclass 820 visa, which is a temporary partner visa that lets them live in Australia. Then an application can be lodged for a Subclass 801 visa, which makes the relative an Australia permanent resident.

Applications for both these visas can be lodged at the same time by paying the application charge for just one. The processing of the application will take place in 2 stages. There will be a gap of 2 years between the processing of the 2 visas.

To be eligible, you have to be married to or be having a de facto relationship with either of the following:

  • A citizen of Australia
  • An Australian permanent resident
  • A New Zealand citizen who is deemed eligible

Subclass 300 (Prospective Marriage visa)

With this visa, you can arrive in Australia to marry your prospective spouse and then apply for a Partner Visa to settle down in Australia. Also, you can stay in Australia for 9 to 15 months counted from the date of granting of the visa. You can also work and study in Australia.

For eligibility, you must

  • Be sponsored
  • Be at least 18 years of age
  • Have the intention to marry your prospective spouse before the visa gets expired
  • Be outside Australia at the time of lodging an application

Subclass 101 (Child visa)

This visa enables a child to immigrate to Australia to live with his/her parents in Australia. To be eligible, the child must be:

  • A dependent child of a parent who’s a citizen or permanent resident of Australia or a citizen of New Zealand
  • Either
    • Under 18 years of age, a full-time student of age between 18 and 25, and financially dependent on the parent, or
    • Aged above 18 years and cannot work owing to a disability
  • Single and have a dependency on the parent
  • Outside Australia at the time of lodging an application

Work-based PR

Here are some options for PR visas based on work in Australia.

Subclass 186 (Employer Nomination Scheme visa)

If you are a skilled worker and are nominated by an employer in Australia, you can use this visa to live and work in Australia permanently.

The basic eligibility requirements for this visa are:

  • You must be nominated by an employer in Australia
  • You must possess the required skills to do the job
  • You must meet the character and health requirements

Subclass 189 (Skilled Independent Visa)

This visa is meant for you if you have been invited to work in Australia as you possess the necessary skills. With this visa, you can work anywhere in Australia permanently. You can also sponsor relatives deemed eligible for an Australia PR visa.

To be eligible you must

  • Have an occupation on the skilled occupation list that’s relevant
  • Have undergone a skills assessment that’s suitable for the particular occupation
  • Satisfy the points test
  • Be invited to lodge an application for this visa

Subclass 190 (Skilled Nominated Visa)

This visa allows skilled foreign workers who are nominated by Australian states or territories to live and work in Australia with the status of permanent residents. Holding this visa, you can sponsor eligible relatives for Australia PR.

To be eligible for this visa, you must:

  • Have an occupation on the skilled occupation list that’s relevant
  • Have undergone a skills assessment that’s suitable for the particular occupation
  • Satisfy the points test
  • Have received an invitation to apply for this visa
