USCIS issues 65,000 more H2B visas for 2023 temp migration; Register now!

Highlights: Additional H2B visas to be made available in FY 2023

Wouldn’t it be great for both US employers and foreign workers interested to work in the US to get more visa opportunities to migrate to US? Something to that effect has happened recently as the US government has decided to make more H2B visas available in FY 2023. This will enable US employers to plan for worker requirements in peak seasons in 2023.

The H2B visa is a non-immigrant visa that helps US employers to hire workers who are foreign nationals to arrive in the US temporarily and work in job roles under non-agricultural services/labor. Their employment will be on a temporary basis. H2B is used for employing foreigners on a seasonal, one-time, intermittent, or peak-load basis.

With the decision to make around 65,000 more H2B visas available in FY 2023, the US government is helping US employers to plan their peak season worker requirements more effectively with high productivity in view. The workers who will be hired will include both skilled and unskilled people.

The current allocation of H2B visas can be dissected in the following manner as we have come to know from USCIS:

  • About 44,700 visas will be available for hiring workers returning to the USA, having received an H2B visa or were alternately granted the status of H2B during one of the three fiscal years (FY) that preceded.
  • The remaining visas (20,000) are set aside for the nationals of the following countries irrespective of whether they are returning workers:
    • Guatemala
    • El Salvador
    • Haiti
    • Honduras

Other details on the new update

The statutory cap applied semi-annually which is authorized under the Immigration & Nationality Act was 33,000 H2B visas. This was set for the first half of FY 2023. However, this cap was already reached on September 12, 2022.

Hence, now the additional visas have been allowed to make it possible for US employers to meet the requirement of a sufficient number of temporary employers for high seasonal productivity.

Here are some more specifics in this scenario:

  • 18,216 visas are readily available for the first half of FY 2023, which are limited to workers returning to the US, irrespective of their nationality.
  • 16,500 visas are available for the early latter half of FY 2023 (the period between April 1 and May 14) which are limited to workers returning to the US, irrespective of their nationality.
  • 10,000 visas are available for the late second half of FY 2023 (the period between May 15 and September 30) which are limited to workers returning to the US, irrespective of what their nationality is, and for which they have to submit petitions after 45 days past the reaching of the statutory limit of the second half is reached.
  • The temporary final rule comes with many provisions that are meant to provide protection to workers from both US and H2B visa holders from abuse and exploitation.
