USCIS rescinds Trump era guidance on H-1B visas for computer programmers

Computer programmers looking to work in USA have good news as the H-1B cap season is going to begin. The USCIS will be, with immediate effect, rescinding a Trump era memo issued in 2017. The memo had raised doubt on whether computer programmers are qualified for H-1B visas.

The guidance memo of 2017 was issued while the executive order for “Buy American, Hire American” led to many REFs and denials. The cancellation of this 2017 guidance came after a decision made in the Innova Solutions vs Baran case in December 2020. The court concluded that the decision of USCIS to deny the H-1B petition was arbitrary.
