Australia dependent permit process

Australia has provided many provisions for the immigrants to move their dependents to the country.

Australia offers Dependent Permits to almost every category of immigrants like work permit to study permit. They can bring their dependents or partners and children based on the Australia Dependent Permit.

Subclass 309 visa (partner provisional visa)

Through this permit, the spouse or de facto partner of an Australian citizen, Australian permanent resident or qualified New Zealand citizen can stay in Australia on a temporary basis. The first step in Permanent Partner Permit (subclass 100) is to have a genuine relationship with the spouse or de facto partner in Australia while submitting for the permit.

The Subclass 309 permit is a temporary permit and the candidate must reside outside Australia when submitting for this permit.

The Subclass 309 permit holder can:

  • Work in Australia
  • Study in Australia
  • Travel to and from Australia as many times as needed
  • Attend up to 510 hours of free English language classes provided by the Adult Migrant English Program
  • Make use of Australia’s public health care scheme, Medicare

Family members including dependent children can be included in this and their permits will be approved if they meet particular health and character requirements.

Duration of stay
  • Family members including dependent children can be included under this permit. The stay will be temporary until a decision on the Permanent Partner (Migrant) permit (subclass 100) is made. The average length of stay ranges from 15 to 24 months.
Subclass 100 permit

This is granted to the individuals having Subclass 309 permit. Holders of this permit are allowed to stay permanently and can submit for citizenship later. For this, the candidate need to have a genuine and ongoing relationship with the partner living in Australia.

Australia dependent permit for children

Various child permit categories are available in Australia to assist immigrants in bringing their biological child, adopted child, or stepchild to the country. Either the parent is a resident of the country or has a Permanent Residency.

If one of the parents is an Australian citizen or holds an Australian Permanent Residency, a child born in Australia automatically receives Australian citizenship.

The Dependent Child Permit in Australia consists of four subclasses, they are:

  • Child Permit 101
  • Child Permit 102
  • Child Permit 802
  • Child Permit 445

The candidate must be either an Australian citizen, hold a permanent resident permit for Australia or be a citizen of New Zealand

For student dependents

If the candidates lands in Australia under study permit, then they are allowed to bring their family along. The candidate can include them in the initial student permit or can submit for their permits separately after beginning the course in Australia. Dependent Permits are available for spouses, partners, and unmarried children under the age of 18.

If the candidate is including the dependent family members in the original student permit, they need to fill out Form 157A with all the details. The student permit holder must have a valid permit for at least 12 months and have sufficient funds and insurance to cover all expenses during that period.

 Requirements
  • Form 919, Nomination of student dependents
  • Form 157A, Application for a student permit
  • A letter from one of your teachers stating:
    • Name of your course
    • Length of the course and your expected completion date
    • If you are satisfying all the course requirements;
  • Proof that you can financially support your dependent family members
  • Proof of family ties such as marriage certificate or birth certificate
  • Proof of school enrolment of school-aged children
  • Proof of health insurance for dependents

For post study work dependents

The Post Study Work Permit holders must show proof of employment and necessary funds along with other documents like relationship proof and Police Clearance Certificate (PCC).

For work permit dependents

Your dependent family members are entitled to join you in Australia on Dependent Permits if you are coming on a work permit.

Only your spouse or de facto partner, as well as any unmarried children under the age of 18, are eligible for dependent family permits if you are visiting Australia on a temporary worker permit.

If you are coming to Australia on a migrant worker or business permit, any dependent family members are eligible. These include:

  • Spouse or de facto partner
  • Any children under the age of 25

Aged dependent relatives such as parents or grandparents.
