Unethical agents are exploiting international students in Australia

The Australian Govt. had set up an inquiry for regulating migration and education agents. The inquiry provided 10 recommendations for the same. The inquiry also brought to notice that there was no accountability for education agents in Australia. Thus, there have been instances where unethical education agents are found exploiting international students.

In March 2018, the Joint Standing Committee on Migration began. The Committee intended to examine the present regulations of migration and education agents in Australia. A 138-page report submitted by the Committee in February recommends the establishment of an education agent register. It was also recommended to put more checks into an agent’s qualification. A sanction system for non-compliant agents was also recommended to be put in place.

The Report’s first page pointed out that the current Australian immigration system had certain loopholes. Organized crime and unlawful labour-hire companies often exploit these loopholes.

Unlawful education agents, in many instances, have been found making false promises to foreign students. One of the illegal practices that they follow is to promise a PR route through a certain course when it is not.

Unethical education agents have often, in a bid to buy time, advised people to apply for a Student Visa. These people use this extra time to look for a job or sponsor in Australia. Unethical education agents have also been found doling out unregistered immigration advice.

It is illegal in Australia for education agents to be giving migration advice, as quoted by SBS News. You are allowed to give immigration advice only if you are a registered MARA (Migration Agents Registration Authority) Agent.

It has often been found that Student Visa applications are being lodged by education agents. They have also been found lodging Work Visa and PR Visa applications for overseas students who have completed their course in Australia.

The Report also said that the education agents have not been adequately regulated by the Dept. of Home Affairs.

Suppose you are a Residence Visa holder of the UAE. You plan to visit India for a month long vacation from June 5th to July 5th. However, your Residence Visa expires on the 6th of July. Would you be able to leave the UAE and return without any hassles?

The answer is yes.  A resident of the UAE may be able to enter the UAE as long as the Visa is valid. Hence, you may enter the UAE even a day before visa expiry.

What are the exceptions to the visa validity rule?

Staying for more than 6 months out of the UAE may lead to cancellation of your Residence Visa. UAE residents who leave the UAE for more than 6 months have their Residence Visas cancelled and need to apply for new ones to re-enter the country.

However, there are exceptions to the visa validity rule:

  1. If the wife of a UAE resident is a foreigner and on the sponsorship of her husband, she may be allowed to enter the country. This is despite the fact that she may have spent more than 6 months abroad.
  2. Domestic workers who accompany a UAE resident to study abroad will not lose their Residence Visas for staying abroad for more than 6 months
  3. Domestic workers who accompany a UAE resident for medical treatment abroad will also not lose their Residence Visa
  4. An expat in the UAE who goes abroad for medical treatment for more than 6 months also does not lose the Residence Visa. However, their medical reports need to be approved by the Ministry of Health, as per Khaleej Times.
  5. Domestic workers who accompany Diplomatic or Consular members abroad also do not lose their Residence Visa

What you must know about the UAE Long-term Visa system?

In November 2018, a new Long-term Visa system was announced by the UAE Cabinet. The UAE Long-term Visa would let Overseas Workers stay in the country for 10 years. The Visa system applies to the following professionals –

  • Investors
  • Entrepreneurs
  • Science specialists
  • Outstanding students

As quoted by Relocate Global, the announcement was made by the Dubai Media Office. Earlier this year, the country had planned to issue Residency Visa for up to 10 years. The UAE Long-term Visa is a result of that plan.

Let’s have a look at some of the most important eligibility criteria of the UAE Long-term visa system.

Investors

Overseas Investors get a chance to enter the country for a 6-month period while their UAE Long-term Visa is being processed. They receive a multiple-entry Visa permit until they have the Residency Visa in hand. The criteria they must fulfill are –

  • Overseas Investors buying property worth DH5 million will get a 5-year Residency Visa
  • Immigrants investing at least DH10 million will receive a renewable 10-year Residency Visa
  • To be eligible to get a 10-year Visa, one must meet below conditions
    • They should make public investments worth DH10 million
    • They should invest in an established company in the UAE
    • They can invest in a business partnership
  • The invested amount should be wholly owned by the investor
  • Investors cannot loan the amount 

Entrepreneurs 

Overseas Entrepreneurs must own a business worth DH5 million to be eligible for the UAE Long-term Visa. Also, they should have the approval of an accredited business incubator in the UAE. The country will offer them a 5-year Residency Visa. They can further upgrade to an Investor’s Visa.

Immigrants will receive multiple-entry Visa to enter the country until they receive the Residency Visa. The Visa can be extended to spouse, kids and business partners.

Science specialists 

Overseas Researchers and Specialists will get a 10-year Residency Visa in the UAE. They must have expertise in the following fields –

  • Science
  • Medicine
  • Health
  • Art
  • Culture

However, applicants must hold a job offer from the country. They should have a Ph.D. from one of the top 500 Universities in the world. Their work must have been published by a renowned publication.

Outstanding students

Overseas Students owning a grade of 95 percent or above in secondary school will be eligible for the Visa. Also, graduates with a GPA of 3.75 can get the UAE Long-term Visa. It’s a 5-year long Visa. The Visa can be extended to family members.

UAE has announced that visitors traveling to the country can now submit their Tourist Visas applications in just 15 seconds.

The General Directorate for Residency and Foreigners’ Affairs (GDRFA) of UAE has implemented a new Artificial Intelligence program. Thanks to it, people can now get their visa applications accepted in just 15 seconds. The AI program has already processed more than 5 million visa applications through the GDRFA app.

The GDRFA visa system is connected to other government entities through the new AI program. This allows for faster processing times. The system has been named “Entry Permit 50+”. This symbolizes that UAE has already moved 50 years ahead with regard to technology for visa-processing, said Col. Dr. Omar Al Shamsi. He is the Assistant Director-General for the Entry and Residency Permits.

Speaking to The News, Col. Shamsi said that they wanted to reduce visa processing times. He pointed out that applicants will no longer need to send the same documents while filing for another visa. Documents submitted earlier will now be stored in a database for easy accessibility.

Col. Shamsi also confirmed that the system also tracks suspicious and wanted individuals. It sends details of such people to the relevant security authorities. The system allows no room for security threats.

Visa applications through the GDRFA app can be either done by a sponsor or a travel agency.

The AI uses a website from where it takes and processes the documents necessary for visa approval. To apply through this system one needs to download the GDRFA app. The app is available for both Android and iPhones.

UAE has announced a new Residency Visa system. It offers long-term Visa to Overseas Immigrants that fall under the following categories

  • Investors
  • Entrepreneurs
  • Specialized talents
  • Outstanding students

The Visa would let stay in UAE for 10 years. It includes their spouses and children as well. The decision was made to encourage Overseas Immigrants to migrate to UAE. As quoted by Khaleej Times, UAE wants to grow its business for investors, entrepreneurs and skilled workers.

Let’s have a look at the different categories and criteria included in the new policy.

 INVESTORS

Two types of investors can benefit from this policy.

  • Overseas Immigrants who own a property worth Dh5 million or more will be granted Residency Visa for 5 years
  • Investors investing in business partnership worth a minimum of Dh10 million will receive Residency Visa for 10 years

 

However, there are certain criteria which they would have to fulfill.

  • The amount invested cannot be loaned
  • Investment should be retained for at least three years
  • The Residency Visa could be extended to include business partners provided they contribute Dh10 million
  • The Visa Policy includes spouse and children as well

 

ENTREPRENEURS

Entrepreneurs will be granted a 5-year Residency Visa. Also, they could, in future, upgrade to an investor’s visa. The policy, in this case, includes two categories –

  • Overseas Immigrants having a previous business worth a minimum of Dh5 million
  • Entrepreneurs should be given approval of an accredited business incubator in UAE

The Visa can be extended to include partners, spouse and children.

SPECIALIZED TALENTS

UAE offers 10-year Residency Visa for specialized talents in the fields of Science and Knowledge. The Visa is usually given to doctors, scientists, researchers and creative individuals in culture and art. However, they should have a valid employment contract in the country. The following criteria apply to the candidates.

  • Scientists should hold Mohammed Bin Rashid Medal for Scientific Excellence
  • People with exceptional talents should have their scientific research published in world-class journals
  • Executives should be owners of well-known and internationally recognized companies
  • Doctors need to hold a PhD degree from one of the top 500 universities
  • Researchers must have contributed to a major scientific research

 

OUTSTANDING STUDENTS

UAE offers 5-year Residency Visa to outstanding students if they meet below criteria –

  • They must hold a grade of at least 95 percent in public or private secondary schools
  • Graduates should possess a distinction of at least 3.75 GPA

Saudi Arabia to launch a new Tourist Visa soon

The inaugural Formula E race, Saudia Al Diriyah E Prix, is to be held in Riyadh this year. Saudi Arabia has hence announced a new Tourist Visa to allow international fans to travel to the country.

Tourists would be able to apply for the new visa online. With the launch of a new electronic visa process, Saudi Arabia would be able to open their gates to fans of live sports, music, and culture. The Saudi General Sports Authority said so in a statement to Arabian Business.

Sharek has been launched as part of Saudi Arabia’s Vision 2030 strategy for the future. It is spearheaded by Mohd. Bin Salman, the Saudi Crown Prince.

Organizers have expressed hope that a large number of racing fans would take advantage of the new Visa process and travel to the event.

With the launch of Sharek, Saudi Arabia would be able to share the grand event with the world. This was quoted by Prince Abdulaziz Bin Turki Al Faisal Al Saud, who is the vice-chairman of the Saudi General Sports Authority. He felt that the association of a futuristic and viable sport as the Formula E will pave the future direction of the country. He also hoped that international fans would arrive in the country in droves to witness the sporting spectacle.

The Formula E event has been sanctioned officially by the Federation Internationale de l’Automobile (FIA). The country has worked with UNESCO to build the tracks for this even from its existing road network. The Saudi Arabia Govt. will soon announce more details about the event in the coming weeks.

The Australia Bureau of Statistics released data based on the overseas arrivals and departures for August. The yearly rate of net overseas migration has increased in the last 3 months. The immigration levels now are similar to the ones during Australia’s mining boom in the early part of this decade.

The ABS, however, warns that overseas arrivals and departures are not a reliable source for immigration statistics. As per the Business Insider, these data may not be appropriate for migration data as they do not have a reasonable track record. Hence, they cannot be used as a leading indicator of immigration statistics.

ABS will release the next set of demographic statistics by December this year. The statistics will contain data up to the June quarter this year.

It is beyond doubt that more immigrants are now moving to Australia. The net overseas migration rate is accelerating. It is evident in the improvement in the Australian economy over the last year.

Temporary Residence Visa options in UAE

UAE is currently bloated with endless opportunities. For people hungry enough to grab them, it offers temporary residence called as ‘Residency Visa’. It lasts for a maximum period of two to three years, giving one opportunity to renew it thereafter.

Both the work and the residence permit come together with an identity card which is used by the country instead of a passport.

Now let’s have a look at the criteria one has to meet to be eligible for the visa –

 

  1. Ownership of Property in Dubai 

An investor must own properties worth Dh1 million or more. Mortgages are acceptable, but in that case, a minimum 50 percent of its original price must be paid off. Acceptable Properties include Apartment and Villa or Townhouse. Non Acceptable properties include Office space, Hotel room or Apartment or any other commercial property. The Visa, in this case, is valid for 2 years. However, it does not authorize the holder to work in the country.

 

  1. Owning a Company 

If one owns a company, either in the Free Trade Zone or Mainland, they can apply for residency as a company’s shareholder. It also provides the right to sponsor employees. The residency visa, in this case, is issued for a maximum period of 3 years. However, the expense of company registration and annual maintenance could be punitive.

 

  1. Holding Employment Contact

Any foreign expatriate, holding an Employment Contract in Dubai, can obtain the Residency Visa. In this case, the hiring company takes responsibility for the visa process. However, to sponsor one’s spouse and children, their salary should be ranging between Dh3,000 to Dh4,000. In the case of parents, it is Dh20,000.

 

Keeping the Visa Active:

For option second and third, if the holder is outside UAE for more than 179 days the visa gets expired. In the same way, the investor visa (first option) is valid till 360 days. Expiry means you have to apply for the cancellation process and reapply for the residency visa.

The Federal Authority for Identity and Citizenship (FAIC) has announced that UAE is all set to introduce new Visa reforms from October 21. The new Visa system would be beneficial for families and visitors.

Visa for widows, divorcees

Under the new Visa system divorcees, widows, and their children will be granted a one-year extension on residency visa. This extension of one year would start from the day of divorce or death of the spouse. A sponsor is not required to apply for this Visa. The Visa aims at given women an opportunity to adjust to their economic and social status after the loss of the spouse. Earlier, women were required to leave the country in the case of divorce or death of the spouse.

Student Visa

Students who are sponsored by their parents will get a 2 year Visa after 12th Grade. Initially, a one-year Visa would be granted after 12th grade or to those who have completed their college or University studies. This Visa would be renewable for another one year. To avail the Visa, parents would need to pay Dh5000, as per The Khaleej Times.

Visit Visa extension

People holding a Visitor Visa for UAE would be able to apply for a 30-day extension twice without leaving the country. In the past, people had to leave the country after the expiry of their one-month tourist visas or 3-month visitor visas. A fee of Dh600 would be charged for each extension.

According to a Dubai Study, India could soon overtake China as the fastest-growing target market for international students.

As per foreign Universities, India is growing even more rapidly than China in sending students abroad for higher education. The study conducted by BMI Media and the Dubai International Academic City (DIAC) spoke to over 104 Universities in UAE, UK, UK, Canada, and Australia.

The Khaleej Times quoted Mohammad Abdullah of DIAC as saying that India and China were the leading markets of international students coming to Dubai. This could be due to the flexibility and the simple visa process. There are a lot of Indian expats living in Dubai. Their children are joining various Universities along with the students coming from abroad.

The study had asked the Universities overseas to rank the countries in the order of international students. China ranked 1st with 17% with India close on its heels with 16.8%. Nigeria was at 5% while Saudi Arabia and Pakistan were at 4.9% and 4.8% respectively.

Abdullah said that with the current visa reforms, UAE is all set to become even more attractive to international students.

UAE had recently made an announcement that students who do exceptionally well in Universities of UAE would be granted a 10-year residency visa. Other students would be eligible to apply for a 5-year residency visa in the UAE. Students on a dependent visa will be granted an extension so that they may find employment opportunities in the country after completing their studies. Universities in the Gulf country can definitely benefit from the current visa changes.

14% of the Universities that were surveyed by the Dubai study reported a decrease in the number of international students. 60% of these were Universities from the USA which reported that due to the immigration policies of the current Govt., lesser students are now opting for the USA.

Canada, on the other hand, has seen a surge in the number of international students. There has been a growth of over 11% in the Universities of the Maple Country.
