Ontario’s latest draw invites 24 candidates on June 24

Ontario’s latest draw held on June 24, 2020

Ontario’s latest draw held on June 24, 2020

In the latest draw conducted by Ontario, 24 invitations have been sent to candidates to apply under the Entrepreneur stream.

The draw was conducted by Ontario Immigrant Nominee Program (Ontario PNP) on June 24, 2020. The candidates for Canada immigration who were involved in this draw were those who got their Expression of Interest (EOI) scores in the period from November 22, 2019, to June 19, 2020. The EOI scores ranged between 134 and 200.

After this draw, the total number of entrepreneurs invited by Ontario in 2020 came to 2020. This was the third Entrepreneurial draw of this year.

Based on the area in Ontario where the business is proposed, the investment requirements and minimum net worth were set as follows

Area Minimum net worth Investment needed
Greater Toronto Area (GTA) $800,000 $600,000
Outside GTA $400,000 $200,000

The rates of minimum net worth and investment needed have seen some considerable decrease with this draw, compared with earlier draws. This is one of the very positive signs for immigrants from immigration Canada.

The candidate in this draw requires 24 months of experience in business in the capacities of a senior manager or an owner in the past 60 months.

Legal options against visa cancellation now in Australia

Legal_options_against_visa_cancellation_now_in_Australa

Visa cancellation could have serious consequences in a country you live in or visit. The visa holder must ensure that his/her time in the country does not get treated as illegal. That could invite penalties and even deportation.

In immigration Australia, you have ways to tackle the situation involving visa cancellation. Basically, one has to remember that having no valid visa makes one an unlawful citizen in the country.

When a visa is deemed to be canceled, you receive a notice from the Department of Home Affairs. This Notice of Intention to Consider Cancellation of visa raises a chance for you to find legal counsel as soon as possible. The deadline for seeking legal advice could be as slim as 2 days, which makes it extremely important to be missed.

An example of visa cancellation is when incorrect information is found given while applying for say citizenship. If you get involved in such a case, there are things you can do legally to explain genuine reasons for documents missing or any detail verified wrong or doubtful.

Yet another scenario for visas getting canceled automatically is when one is sentenced to do term for a year or more in prison. Then, reapplying for a visa directly to the Minister of Immigration is a way to go. As long as the reapplication meets its decision, the applicant undergoes immigration detention.

There are also cases of Australian visa holders who ill-treat their family members with temporary visas, threatening to cancel the victim’s visa. But in case the victim reports such abuse to the Department of Immigration, those who they are dependent on in Australia will be booked and the victim’s visa will not be canceled.

Though the individual cases leading to challenging a visa cancellation are different, as a general procedure, people have the right to appeal against cancellation at the Administrative Appeals Tribunal (AAT). This is possible if the visa has been denied or canceled under Section 501 of the Migration Act.

Another place to seek a judicial review is the Federal Circuit Court. You will have the right to enquire if there was a legal mistake in the manner the decision to cancel your visa was made at the AAT.

In fact, when an applicant comes before the AAT with a legal representative, the chances of success in the case increases about 7 times.

Apply for a bridging visa before one’s original visa expires is one way of staying on in Australia.

As the COVID-19 crisis is making it impossible to go out of countries due to lack of flights, such a situation could be cited as a genuine argument to challenge visa cancellation.

Australia is helping by giving $400 as a one-off payment to each family of those who came to work in Australia and has since lost it as with casual laborers. International students get such help too as they are struggling with visas that are about to expire.

France makes stay back at ease for stranded Schengen travelers

France visa permits to Schengen

France visa permits to Schengen

There is a respite for those who are stuck in France holding a Schengen visa, because of world-wide travel restrictions in effect. France has now decided to issue such travelers with provisional residence permits. This will make their stay legal if their Schengen visas have expired.

For those travelers with a Schengen tourist visa that is nearing expiry, France will extend the validity of the visa for a maximum of another 90 days.

All the travelers who arrived in France before March 17, 2020, and could not leave France due to travel restrictions imposed by world nations, will benefit from the new decision.

In other words, all third-country nationals who aren’t able to leave France for legitimate reasons will be treated with provisional residence permits or visa extension.

There are those who hold

  • French residence permits,
  • receipts for renewal applications of residence permits that expire between March 16 and May 15, 2020, and
  • long-stay visas

stranded out of France owing to flight disruptions. These people will be able to come back to France as soon as the situation allows.

Those who hold a Schengen visitor visa for short-stays used to travel to France before the pandemic, and now stuck there, can apply for new visas using a simpler procedure with lesser document requirements.

Canada’s Express Entry draw

Canada’s Express Entry draw

An Express Entry draw that was conducted on June 25, 2020, has issued invitations for 3,508 immigration candidates and their families to apply for permanent residence.

The Canadian Experience Class (CEC) candidates who got Invitations to Apply (ITA) had a Comprehensive Ranking System (CRS) score as low as 431.

This score was the second-lowest ever after the draw that was held on May 31, 2017. That draw had a CRS score of 413.

392 ITAs were issued to PNP (Provincial Nominee Program) candidates on June 24, 2020. The June 25 draw followed this and brought the total ITAs issued in these 2 days to 3,900.

The Express Entry system manages the profiles of candidates belonging to 3 main economic-class immigration programs namely:

Immigration, Refugees and Citizenship Canada (IRCC) has been aiming at PNP and CEC candidates in the draws that were held in the last 3 months. These candidates bring the advantage of mostly being in Canada because of which they are least possibly affected by COVID-19 restrictions.

Ever since the COVID-19 preventive measures have been imposed by Canada, the CRS score requirements have gone down considerably.

The June 25 draw applied the tie-breaking rule that was implemented on April 3, 2020, at 12:56:32 UTC. So, all candidates with a CRS (Comprehensive Ranking System) score of 431 and have submitted their profiles prior to this date and time got an ITA in this invitation round.

It is recommended that prospective candidates submit their profiles in the Express Entry pool so that they have a better chance at getting selected, especially as the CRS score requirements are falling with every draw.

PEI’s June 2020 draws gives a positive picture of immigration

Prince Edward Island PNP Draw

Prince Edward Island PNP Draw

PEI (Prince Edward Island PNP) conducted 3 PNP (Provincial Nominee Program) draws in the month of June 2020. 90 Canada immigration candidates were invited in these draws.

The first draw was held on June 10, 2020. It invited 9 candidates from the Express Entry and Labor Impact streams. Another draw was held on June 18, 2020. 10 invitations have been sent to candidates of the same categories in the draw.

In the draw conducted on June 23, 2020, 91 invitations have been issued. The candidates included those who belonged to the Business Impact stream. Out of the 91, 20 candidates belonged to the Business Impact stream. It was also the first time candidates of this stream have been invited after the COVID-19 pandemic struck Canada. In the same draw, 71 Express Entry and Labor candidates constituted the rest of those invited.

The PEI PNP Express Entry is aligned with the Express Entry system of the Government of Canada. The Express Entry has the task of managing applications for economic class categories in immigration namely:

  • Canadian Experience Class
  • Federal Skilled Trades Program
  • Federal Skilled Worker Program

The candidates eligible to participate in an Express Entry draw will get a Comprehensive Ranking System (CRS) score for their profiles based on human capital factors like age, education, work experience, and language proficiency in English and French.

Candidates who receive provincial nomination will be awarded 600 extra points on their original CRS scores. This, in effect, will guarantee the issue of Invitation to Apply (ITA) for permanent residence in an upcoming Express Entry draw.

To be eligible for a provincial nomination from PEI, Express Entry candidates must create an EOI (Expression of Interest) profile with PEI PNP. These profiles will then be given points and the highest scorers will then be invited to apply via monthly draws.

Germany has brought an ordinance to effect that assists those with expired Schengen visas to stay for an extended period in the country. The ordinance permits such people to stay who are stuck in Germany due to COVID-19 prevention measures. They can be in Germany till 30 September 2020, with no need to hold a residence permit.

This ordinance that is significant in Germany migration is applied to every foreigner:

  • Who entered Germany’s federal territory not before 17 March 2020, and stayed in Germany until 30 June 2020, or
  • Who were in Germany’s federal territory on 17 March 2020, holding a valid Schengen visa.

British Columbia Tech Pilot draw

British Columbia Tech Pilot draw

British Columbia (BC) conducted its latest tech pilot on June 23, 2020. It invited 87 candidates with jobs offered in BC’s technology sector to apply for permanent residence.

British Columbia Provincial Nominee Program (British Columbia PNP) issued invitations in this draw to candidates under the Skills Immigration and Express Entry BC categories.

Those candidates selected from the Skilled Worker and International Graduate sub-categories required a minimum score of 80.

The most recent extension to the BC PNP Tech Pilot project applies until June 2021.

For eligibility to participate in this immigration program, candidates must register themselves in any of BC’s existing immigration streams that are provincial. The province should also extend a job offer that’s valid for a minimum period of 12 months. This job must be in any of the 29 jobs considered eligible by Tech Pilot.

  • work experience
  • age
  • education level

US stops work visas for 2020; Canada, Australia best bets now

US freezes work visas

US freezes work visas

The US President Donald Trump has finally declared that job-based immigration to the US has been suspended from June 24, 2020 till December 31, 2020.

The executive order to this effect will cause no new visas for US immigration to be issued in the following categories:

  • H-1B– This is a non-immigrant visa that US companies use to hire graduate foreign workers. They employ the workers in occupations that require expertise and specialization.
  • H-2B– This is a visa for temporary workers who don’t work in USA as part of the agriculture industry. The US businesses will hire these temporary workers to solve the lack of native workers to ensure the sustenance of their businesses.
  • J visas– These are Exchange visitor visas. These are non-immigrant visas for those approved to take part in the US exchange visitor programs.
  • L visas– These are work visas that are available to people in managerial positions. They have specialized knowledge and get temporary intracompany transfers.

The new order by the US President applies to those outside the US, not having a US work visa. The order however empowers the US government to lift the suspension for certain people. Those seeking asylum in the US won’t be subject to the order.

This new development has now prompted prospective migrants to focus on the next best choice, Canada. Canada has kept its status as a prominent choice for students and skilled workers even while restrictions were imposed to fight COVID-19. Canada keeps on conducting immigration draws, inviting more immigrants to the country.

It’s already seen that those in the US with USA work permit, finding it hard to get a Green Card, choose to try for Canada permanent residency. Canada gives much more opportunities for permanent residency.

The foreign workers in the USA even get an advantage in Express Entry draws for permanent residency. Their good language skills, work experience in the US, and high level of education help them in it.

International workers should consider this as an opportunity to explore job opportunities in Canada. The country is already reputed for its ambitious immigration policies. It tries to improve its economy with the help of immigrants.

Canada is continuing to hold its immigration draws both at the federal and provincial levels. That makes Canada the obvious choice for international immigrants in this circumstance.

Another country worth considering is Australia. The country is looking for a large number of skilled immigrant workers. It’s inviting them via its skilled migration events. It will be a wise decision to apply for an Australia work permit now. You will find that you will get work opportunities as great as what you expected in the USA.

Australia to roll out a new program for foreign students’ return

Australia foreign students

Australia foreign students

The significance of international students in Australia’s immigration scene is becoming clear with the latest measures planned by the Australian government.

The Australian Capital Territory (ACT) will initiate a pilot program to help the return of international students. This pilot program is going to start in July 2020. The program will gradually be adopted in entire Australia by its states and universities.

This step is an important part of the government’s 3-phase plan for re-opening Australia. To achieve this, restrictions will be eased for the international students at the border allowing them to come to study in Australia.

The importance of students returning to the country is owing to the thousands of dollars they bring to Australia and its universities. This will help to create jobs and power up the economy.

After the impact of COVID-19, the decrease in foreign students in Australia has already incurred a huge loss to the country. The universities themselves have suffered an estimated loss of $8 billion. The economy of the country has had an estimated loss of $30 billion.

An ongoing reduction in international students could create a loss of $40 billion to the Australian economy by 2023. So, bringing back foreign students has been treated as a priority and necessary measures have been taken.
