LMIA is a government mechanism. It reviews employee applications invited by employers in Canada. It ensures that hiring a foreign worker will create a positive or no effect on the Canadian labor market. It also ensures that no qualified Canadian worker is rejected in favor of a foreign worker. Moreover, it is made sure that the foreign worker will get a salary and benefits at par with federal and provincial standards.

Now, the Canadian government has initiated a new facility for employers. They can now manage LMIA applications via an online portal. The new pilot project answers the constant request from Canadian business leaders and employers. They have been urging the government to streamline the current LMIA process.

The pilot project will test the efficiency of the portal with the Temporary Foreign Worker Program (TFWP) employers. They will register for online access to manage their accounts. They will also conduct transactions and correspond with Service Canada via this online portal.

Service Canada is part of a Canadian government’s service transformation initiative. It facilitates better, less cluttered, and more responsive service from the Canadian government.

The portal is made accessible with the same login credentials that employers use to access the Job Bank . The portal will have an electronic questionnaire. It will guide the user through the completion of the LMIA application. The user can track its progress too.

Users can upload supporting documents with the application in the portal. It can also help users view Service Canada decision letters.

The new online portal will ensure that the red tape and processing time will be reduced considerably. Several improvements have been suggested by groups like the Canadian Chamber of Commerce and the Canadian Federation of Independent Business (CFIB).

The CFIB published a report last month. It cited the concerns of small to medium-sized businesses with hiring foreign talent through the current TFWP process. It’s a complicated, lengthy and expensive process currently. The online portal will definitely be a step in making the process faster and more accurate.

The major advantage of the online portal comes with how it enables employers to track the applications. This will reduce waiting time to a large extent.

Also, the portal makes communication of the reasons for rejection of applications easier. This will give the employer the chance to realize why the rejection happened. Such knowledge will help them decide if it’s worth it to apply again.

If you have an American dream, you must have heard about the green card. It’s the document that acts as your PR visa in the USA. The green card is a non-US citizen’s proof of being a permanent resident in America.

The green card is a dream achievement for many. That’s because it allows them to live and work anywhere in the United States, lawfully. Moreover, it qualifies them for U.S. citizenship after 3 or 5 years.

The U.S. government issues over a million green cards annually. The priority of the issue is given to the family members of US citizens or green cardholders. Then comes the workers from other countries looking for jobs in the United States.

The green card comes in many categories. These may be:

Family-based green card

This type of green card applies to close relatives of U.S. citizens and current green cardholders. The family members eligible for applying for this type of green card include:

  • Siblings
  • Parents
  • Spouses
  • Children

Spouses and children of those siblings, spouses, and adult children listed above are also eligible. Widows/widowers who were spouses to a US citizen at the time the citizen died are also eligible for this green card.

Among those who don’t qualify for this green card are aunts and uncles, cousins, and grandparents. They may apply for a green card if they have a close relative as listed above.

Employment-based green card

This green card applies to you if you are a worker in the USA. In some cases, even your spouses and children may qualify. The categories under this type are:

  • Priority workers (EB-1) – This includes those in arts, sciences, education, business, and athletics. They must have achievements, recognized through extensive documentation. It also includes outstanding professors & researchers and multinational managers & executives.
  • Professionals with advanced degrees & exceptional abilities (EB-2) – This includes those requiring master’s or bachelor’s degrees (with a minimum of 5 years of relevant experience). It also includes workers in positions of national interest or in arts, science or business with exceptional abilities.
  • Physicians (EB-2 with a special waiver) – This includes physicians who agree to work full-time in underserved areas for a specific period.
  • Skilled, unskilled, and professional workers (EB-3) – This includes skilled workers in positions requiring a minimum of 2 years’ training or experience. It should also not be temporary or seasonal. It also needs those in positions requiring at least a bachelor’s degree from a US university or college. An equivalent of this degree from a non-U.S. school is also allowed.
  • Special workers (EB-4) – This includes professionals from media, religious workers & ministers and certain other employees, retirees and their family members. Afghanistan and Iraq nationals who have served the US government in certain capacities.
  • Investors (EB-5) – This includes non-US nationals who have invested or are investing at least $1 million in a new US business. The business must create full-time positions for at least 10 workers.

Humanitarian Green Card

This type applies to you if you are:

  • Refugee and asylee
  • Human-trafficking victim
  • Crime victim
  • Abuse victim

Diversity Lottery Green Card

This green card applies to you if you have won selection in the annual green card lottery. The lottery is also called the Diversity Visa Lottery Program.

Longtime-Resident Green Card

This green card applies to you if you have physically lived in the United States, lawfully or unlawfully, since January 1, 1972. In this case, you are essentially undocumented. You can apply for a green card through a special process called ‘registry’.

How to apply for the green card

Step 1

The application process for a green card should be preceded by 2 basic considerations:

Are you eligible to apply?

There are many ways to apply for a green card with different eligibility requirements. These vary depending on the category of immigrants you come under. The categories are:

  • Green card via family
  • Green card as a special immigrant
  • Green card via employment
  • Green card via refugee or asylee status
  • Green card for victims of abuse
  • Green card for victims of crime and human trafficking
  • Green card via the registry
  • Green card via other categories

You can apply for a green card by filing two forms:

  • A petition for immigration
  • A green card application (Form I-485)

The petition is usually filed by the one who represents or sponsors you in the US. The types of petitions include:

  • Form I-140 – immigrant petition for an alien worker
  • Form I-589 – application for asylum and for withholding of removal
  • Form I-130 – petition for alien relative
  • Form I-730 – refugee/asylee relative petition
  • Form I-929 – petition for qualifying family member of a U-1 nonimmigrant
  • Form I-360 – petition for Amerasian, Widow(er), or special immigrant
  • Form I-918 – petition of U Non-immigrant status
  • Form I-526 – an immigrant petition by the alien entrepreneur

Are you inside or outside the USA?

If eligible to apply for a Green Card, you have 2 processes to use – adjustment of status or consular processing.

If inside the USA

In this case, you will use the process of adjustment of status with USCIS. In it:

  • Check if you already have an approved immigrant petition and an immigrant visa is available. If yes, file Form I-485. Also, file an application to Register Permanent Residence or Adjust Status with USCIS.
  • You may not have an approved immigrant petition. Then, you should check if you can file the petition and Form I‑485 together simultaneously. This is called concurrent filing.

If outside the USA

In this case, you will use consular processing with the US Department of State.

Step 2

Your individual situation will decide the steps you must take to apply for a Green Card. However, here is the general application process that most applicants will go through:

  • Someone in the US must usually file an immigrant petition for you. This person is called a sponsor or petitioner for you. You could file for yourself in certain cases.
  • USCIS approves the immigrant petition first with a visa available in your category. Then you may use one of the following options:
    • File a green card application with USCIS
    • File a visa application with the US Department of State
  • You go to a biometrics appointment. There you provide fingerprints, photos, and a signature
  • You go to an interview
  • You receive a decision on your application

Australia solves student visa problems with cancellations

There’s a challenging situation for students who study abroad in Australia. It has presented itself through many student visa cancellations. The number of cancellations by the federal government has come to around 18,000 in 2018-19.

The highest number of visa cancellations are in the name of Chinese students. Out of the 18,000 cancellations, 4686 visas belonged to Chinese students. The next largest number of cancellations were of Korean students. Their number came to 1503 visas.

China’s topping the number of visa cancellations has been the case in Australia since the 2014-15 period. It’s also interesting to note that Chinese account for most international students in Australia. In the last financial year, 45,309 visas went to the Chinese.

On the top of the list of visas canceled are countries like India with 1157 cancellations, Malaysia with 1107 cancellations, and Brazil with 914 cancellations.

The biggest reason cited for these mass cancellations is the failure of students to follow the rules. Many are at fault for choosing inappropriate courses. Providing wrong and incomplete information is also a culprit for causing the cancellations. The submission of bogus documents is yet another reason.

In the 3 months of the current financial year, 4500 visas have already been canceled. The cancellations currently done have their beginnings in a crackdown by the authorities. The systematic crackdown on the bad education agents and providers exposed unfair practices. This included students with original student visas, seven or eight years old, jumping courses to stay on.

Last year, a total of 17,819 cancellations were done. This included 8913 men aged 18-34 and 6129 women in the same age group.

Even though the cancellations have been happening in large numbers, so has the issuance of student visas. The fact is that the student visa is a vital component of Australia’s economy. It supports Australia’s global competiti­veness. The role it plays in strengthening its commercial and cultural links with other countries is huge.

In Australia, the list of occupations graded in 3 categories is called the Traffic light Bulletin. The list considers the latest recommendations and brings the changes required for immigration purposes. It is an important list for migrants coming to work overseas. The list can indicate where their occupational skills stand in Australia.

The Department of Employment, Skills, Small & Family Business releases the Traffic Light Bulletin. It has released the latest bulletin with potential changes to the skilled occupation list. Understanding these changes is essential for immigration purposes.

These proposed changes will not be formalized until its release date in March 2020. Hence there’s no surety of any or all the proposed amendments to occur.

This time, there is a removal or downgrading of certain trades/occupations. There are also occupations added, like those relating to personal and aged care.

There are 3 types of occupation lists in Australia

  • Regional Occupation List (ROL)
  • Medium and Long-term Strategic Skills List (MLTSSL)
  • Short-Term Skilled Occupation List (STSOL)

The occupations that aren’t removed from the list could shift across these lists. These will be joined by the new occupations added to the list.

Red Occupations

The Red occupations have a big chance to get removed from all occupation lists. This time, occupations that see this ranking include:

  • Hairdresser
  • Massage Therapist
  • Community Worker

These occupations have before been popular among migrants. They had good demand in Australia too.

Orange Occupations

Orange occupations are very transitional. These occupations can move between the three occupation lists STSOL, MLTSSSL, and ROL.

Occupations that may be downgraded from MLTSSL to the STSOL list include

  • Painting trades workers
  • Automotive electricians & motorcycle mechanics
  • Wall and floor tilers

Occupations that may move from the ROL to the STSOL include:

  • Real estate representative
  • Mechanical engineering draftsperson

This will give the option for employers in non-regional Australia to sponsor visas.

Occupations that have a big chance to move from the STSOL to the MLTSSL are:

  • Sales & Marketing Manager
  • ICT Project Manager
  • Information & Organization Professionals (includes Data Scientists)

This move can enable 482 visa applicants to seek permanent residency. It will also give migrants the chance to apply for a Skilled Independent 189 visa. These occupations also come with a recommendation for salary caveats beyond a certain level.

A geologist could be an occupation that will move from the STSOL to the ROL list. This would limit applicants to those living and working in regional Australia.

There are occupations that could make the big jump from the ROL to the MLTSSL. These include the Procurement Manager and Ship’s Master. In this case, employers will get to sponsor employees beyond regional Australia.

Green Occupations

Many personal support occupations have been marked to be added to the STSOL. These occupations have been staying off all lists for a while now. This time, aged or disabled careers, nursing support workers, and personal care assistants could get added. There has been a recommendation that these occupations involve a mandatory skill assessment.

Occupations with salary caveats

Certain occupations will see no changes in the list. But the Department has recommended the implementation of a minimum salary caveat for them. This will amount to AU$65,000 per annum for Pastry Cooks, Bakers, and Fitter and Turners. A minimum salary of AU$120,000 per annum is proposed for sportspersons (NEC).

Occupations new and emerging

Many occupations have been identified as new and emerging ones by the Department this time. These did not have a place in the ANZSCO system until now.

ANZSCO is the short form of The Australian & New Zealand Standard Classification of Occupations (ANZSCO). It is a classification system based on skills. This will be used to classify occupations and jobs in the Australian and New Zealand labor markets. The objective is to achieve better comparability of occupation statistics from the two countries.

The Australian Bureau of Statistics (ABS) has now determined these occupations with definitions assigned to them.

Under the present system, British travelers must spend $35 (£27) for a permit to travel to Turkey. They can apply online for the permit. From March 2020, British tourists will not need visas to visit Turkey.

The new measure aims at boosting Turkey’s tourism industry. It will increase the country’s potential with European countries as the tourists will get an impetus to travel to Turkey. It will also benefit relations with European countries in the fields of culture, economics, and trade.

European travelers should ensure that their passports are valid for a minimum of 6 months from the date of entry into Turkey. Also, there should be a full blank page to place entry and exit stamps.

In 2018, Turkish EU Affairs Minister Omer Celik had made an important announcement in this regard. He stated that Ankara had met all 72 requirements to secure its citizens’ visa-free travel to the Schengen Area. Turkish officials added that Ankara had submitted all related documents to EU officials to fulfill the visa liberalization process.

New momentum in Turkey’s relation with the European Union and the United Kingdom is expected with this liberalization of visa requirements.

What is a working holiday visa?

The visa is technically named the Working Holiday visa (subclass 417). It is valid for a year and can be applied for 3 times. The first working holiday visa will allow you to stay for 12 months. You need to be 18 to 30 years (both inclusive) to be eligible. French and Irish citizens should be 18 to 35 years old.  The visa holder can work in temporary jobs during their stay in Australia.

The visa can be applied for a second year. For this, the applicant should have held the visa (subclass 417) once. He/she should have also completed at least 3 months’ work in Australia.

To apply for the visa for the third year, the applicant should have held the visa (subclass 417) twice. The applicant should have completed at least 6 months’ work in Australia.

Another visa of the same nature is the Working Holiday visa (subclass 462). Subclass 417 visa scheme is applied to backpacker nations. These include Germany, Canada, the UK, and Sweden. The Subclass 462 visa scheme is applied to developing countries. These include Turkey, Singapore, Vietnam, Thailand, Bangladesh, Indonesia, and China. The Subclass 462 visa is also called a “work and holiday” visa.

How will the changes to working holiday visa help?

Under the present system, employers can hire the same tourists or backpackers for only 6 months at a time. Also, the system doesn’t count volunteer work.

With the changes, regional employers can employ the same backpackers for up to a year. This will be applicable particularly in the fire-affected areas. Voluntary work done in disaster zones will be counted by the system. It will get added to the days of work needed for second-year or third-year visas.

Response to the changes

Backpackers on working holiday visas are happy about the new changes. They find it an opportunity to stay and work longer in Australia. The backpackers will be employed in farm jobs and rebuilding fences in rural areas. The volunteers are even offered daily meals and a place to sleep.

The farmers and rural folks are also very happy about these changes. They are now getting many young people from around the globe who want to help Australia. The employee shortage for works in regional areas is thus getting eliminated.

This year’s first round of invitations to skilled candidates was sent in Australia recently. A total of 1300 invitations went out that enables them to live and work in Australia. 1000 invitations went to Independent visa applicants, coming under Subclass 189. Subclass 189 is a very recent one. The remaining went to the Subclass 491 Skilled Work Regional (Family Sponsored) visa applicants.

This year, the minimum points required was reduced to 90 points.

The invite from Australia presents many occupational opportunities. The list had mostly information technology jobs than any other category. Other categories are in engineering and accounting. Invitations for certain occupations were issued on a pro-rata basis. These occupations have a high level of demand.

The first preference in allocation went to Subclass 189 Expression of Interests (EOIs). The remaining places were issued to the Subclass 491 EOIs, the Family-Sponsored visas.

The top gainers of this round of invitations

The invitations were mostly sent to IT professionals. These included Software & Application Programmers. As many as 298 invitations went to these verticals. The invitations were issued across the Subclass 189 and Subclass 491 visa programs. Of all the invitations, 53% went to the top 5 occupations. These included:

  • Civil Engineering Professionals – 76 invites
  • ICT Business and Systems Analysts – 93 invites
  • Accountants – 98 invites
  • Database & Systems Administrators and ICT Security Specialists – 121 invitations

On the lower side, the following occupations were included:

  • Cartographers/Surveyors (4)
  • Management Consultants (3)
  • Construction Managers (approximately 3-4 invites)
  • Medical Imaging Professionals (approximately 1-2 invites)

The bottom line

One can expect a high level of competition for invitations by March 15, 2020. These invitations will go through SkillSelect. The student visa cohort will expire on this date. In that case, you may look for alternative visa options like:

  • The Subclass 190 State Nominated visa
  • The Subclass 491 Skilled Work Regional visa
  • The Subclass 485 Graduate visa (for International Students who have finished their studies)

The new points-based system contributes to applying such thresholds. This system will be implemented by the year-end. For any immigrant, it will be necessary to earn £25,600 or more from their jobs. The UK Prime Minister Boris Johnson has decided that only skilled migrants will work inside the country. He rules out any special treatment or carve-outs even in the face of resource shortages.

The government reassures that the new system will be simpler and fairer. It will not discriminate between countries. Democratic control of immigration will be reinstated for the British people.

The UK will be welcoming talent from every country of the world. At the same time, it will now end reliance on importing cheap, low-skilled labor. This approach is criticized for affecting sectors like construction and social care. But as it stands, the new rule will not exempt them in any case.

The workers in such shortage occupations will be offered permission under the more demanding points system. These workers may get extra points in certain cases for immigration. But that will not guarantee them entry into the UK.

Ministers are recommending special treatment for foreign construction workers. This will help meeting Mr. Johnson’s promise to complete the fruition of £100 billion of infrastructure investment. Allowing them to come to the UK will ensure that the investment will be converted into results effectively. The urgency for resources created by overlooking the migrants’ role could stall the projects.

Under the new rules, people earning under £25,600 will need 70 points to enter the UK. The points will be given based on salary, education, English skills and job offers at an appropriate skill level. This will mean that those who earn lower wages will need to improve points in other areas.

A series of salary thresholds will also be implemented for jobs with higher earnings. This will mean that a high threshold will be set for high-paid jobs. This will ensure that high-paid newcomers will not get an unfair benefit over existing workers in the UK.
