Unethical agents are exploiting international students in Australia

The Australian Govt. had set up an inquiry for regulating migration and education agents. The inquiry provided 10 recommendations for the same. The inquiry also brought to notice that there was no accountability for education agents in Australia. Thus, there have been instances where unethical education agents are found exploiting international students.

In March 2018, the Joint Standing Committee on Migration began. The Committee intended to examine the present regulations of migration and education agents in Australia. A 138-page report submitted by the Committee in February recommends the establishment of an education agent register. It was also recommended to put more checks into an agent’s qualification. A sanction system for non-compliant agents was also recommended to be put in place.

The Report’s first page pointed out that the current Australian immigration system had certain loopholes. Organized crime and unlawful labour-hire companies often exploit these loopholes.

Unlawful education agents, in many instances, have been found making false promises to foreign students. One of the illegal practices that they follow is to promise a PR route through a certain course when it is not.

Unethical education agents have often, in a bid to buy time, advised people to apply for a Student Visa. These people use this extra time to look for a job or sponsor in Australia. Unethical education agents have also been found doling out unregistered immigration advice.

It is illegal in Australia for education agents to be giving migration advice, as quoted by SBS News. You are allowed to give immigration advice only if you are a registered MARA (Migration Agents Registration Authority) Agent.

It has often been found that Student Visa applications are being lodged by education agents. They have also been found lodging Work Visa and PR Visa applications for overseas students who have completed their course in Australia.

The Report also said that the education agents have not been adequately regulated by the Dept. of Home Affairs.

From 1st July 2019, Australia is all set to increase its visa application fee. A 5.4% increase in the visa application fee has been announced by the Dept. of Immigration.

The visa fee increase will affect all visa subclasses. However, the visa fee for the Visitor Visa would remain the same.

There will be no increase to the second instalment of the Contributory Parent Visa. This news brings cheer to all Contributory Parent Visa applicants. The second instalment fee currently is $43,600 per person, as quoted by SBS News.

All applications which are submitted on or after 1st July 2019 will be subject to the visa increase. Applicants who submit their visa applications before 1st July will be paying the current visa fee.

Australia brings into effect the new Regional Visa (Subclass 491) from 16th November 2019. Even though the Visa will be effective from a later date, the legislation has already been made available. Thus, aspirants planning to apply for an Australian Visa can plan ahead.

The definition of what constitutes a “Regional Area” will also be revised by the Australian Govt. The new definition will be applicable to all Australian visa subclasses including Student Visas.

The below areas are considered as “Regional Areas” in Australia:

  1. All areas outside the metropolitan area of Sydney
  2. All areas outside the metropolitan area of Melbourne
  3. All areas outside the metropolitan area of Perth
  4. All areas outside the metropolitan area of Brisbane
  5. All areas outside the metropolitan area of Gold Coast
  6. The entire state of Northern Territory
  7. The entire state of South Australia

The Australian Govt., however, is yet to release the postcodes of the regional areas.

The requirements of the new Subclass 491 are more or less the same as the Subclass 489 Visa. The Subclass 489 will cease to exist once the Subclass 491 comes into effect.

The requirements of the Subclass 491 Visa are:

  1. The applicant should have sponsorship from a state or territory in Australia. Or, a family member living in a designated area in Australia should have sponsored the applicant.
  2. The applicant should have obtained an ITA (Invitation to Apply)
  3. The applicant must be less than 45 years in age
  4. The applicant should be able to provide evidence of competent English
  5. The applicant should be able to score the required number of points for this Visa

The validity of the Subclass 491 Regional Visa is 5 years, as per SBS News.

Applicants will have to comply with strict conditions on living in a “Regional Area”. The primary applicant and the dependents would be able to live, work and study in designated “regional” areas only.

Subclass 491 Visa holders who meet the 3-year mandatory stay in a regional area would be able to apply for the Subclass 191 Permanent Residence Skilled Regional Visa. The applicants should have complied with all the conditions of the Subclass 491 visa before applying for the Subclass 191 Visa. Applicants will also need to provide tax assessment records for 3 years while applying for the Subclass 191 Visa. Also, the taxable income of the applicants should be above the threshold. The required income level is yet to be announced by the Australian Govt.

The Australian Govt. has changed the points-system for Permanent Residence following the advice of its Productivity Commission.

The point system for both the Skilled Migration and the Subclass 491 (Regional Visas) will be changed. Generally, PR applicants can earn points on their attributes that contribute to the Australian economy. The Immigration system of Australia tries to augment the benefits that immigration brings to the country.

As per the revised system, you can now get extra points on your PR application. Here are the new changes that have been proposed for the point-system:

  1. Applicants who have a spouse or common-law partner fulfilling the “Skilled” requirement will get 10 points. The spouse or common-law partner needs to have a positive Skill Assessment to claim the same, as per SBS News.
  2. Applicants who do not have a spouse or common-law partner will be eligible for 10 points
  3. Applicants whose spouse or common-law partner have competent English will earn 5 points
  4. Applicants who are sponsored by a state or territory in Australia will get 15 points. Applicants who are sponsored by a close relative living in a designated area will also earn 15 points.
  5. Applicants who hold a STEM (Science, Technology, English, and Mathematics) qualification from Australia will also get 10 points

  2. Having a criminal record in the UAE is certain to get your Visa application rejected
  3. At times some immigrants hold a Resident Visa but fail to cancel the same before leaving the country. It is mandatory that you cancel your previous Visa before applying for a new one.
  4. If you had applied for an Employment Visa but did not enter the country, you will first need to clear the same
  5. If you had a Tourist Visa for UAE but did not visit the country, you would need to get that cleared first. The PRO of the Travel Agency needs to visit the Immigration Dept. to do the same.
  6. Any errors on the Visa application like the spelling of the name, passport number etc would result in your Visa getting denied
  7. Nowadays most people prefer to submit their Visa application online. During an online Visa submission, you also need to upload scanned copies of the supporting documents, as per Khaleej Times. The uploaded documents should be clear and legible. If they are not, that also results in a Visa rejection.

What are the Canadian visa requirements for Bermuda citizens?

Walton Brown, Cabinet Minister of Bermuda, announced that a Canadian team could help Bermuda citizens to live, work and study in Canada.

Canada had revealed the new visa requirements for Bermudian citizens last year. Applicants applying after 31st December need to submit a photo and their fingerprints along with their visa application. They will also need to renew their biometric information after every 10 years.

The cost to provide biometric information is CAD $85 for a single applicant. For family applications, the cost is CAD $170.

However, there is no provision for applicants to submit their biometric information in Bermuda. They need to travel all the way to the USA to submit their information.

Mr Brown said the added cost of travelling to the US for their biometrics added a burden to the applicants’ finances, as quoted by the Royal Gazette. He also said that Bermudian families already have to bear the high cost of foreign education. The travel costs to the US add to that burden.

Mr Brown also said that the Govt. is in discussion with the Consulate of Canada in Bermuda to resolve this issue. The Govt. is asking for a Canadian team to come to the country to collect the biometric information. It is also exploring the possibility of the Immigration Dept. of any other authorized organization to become the Visa Application Centre for Canada.

He further added that their Canadian partners have been pretty receptive to the suggestions. Hence, he is very hopeful that a solution to the same will be made available to the public very soon.

To apply under the SINP’s Occupations In-demand and Express Entry sub-category, an applicant needs to have relevant work experience. The work experience should be in any occupation on the In-Demand Occupation List. However, applicants do not need to have a job offer for either sub-category.

The newly revised occupation list was updated by SINP on 4th April, as per CIC News.

The current method of accepting migrants in Australia is the right one, says the Productivity Commission of Australia.

The current method involves screening overseas migrants on the basis of their qualifications and skills. They are given priority on the basis of their education, age, work experience and language proficiency skills. This method of selecting overseas immigrants in more beneficial to Australia.

The Australian Govt. is currently focusing on bringing in migrants with better skills and good education. These attributes help the immigrants integrate better in the workforce. These migrants, thus, give more economic benefit and better labour market results. Working-age foreign immigrants also provide a much-needed boost to Australia’s ageing population.

The benefits of attracting a younger workforce were also highlighted by the Intergenerational Report of Australia. The rate of participation in the workforce is much higher for working-age immigrants, as quoted by SBS News.

Using any other method of accepting immigrants, like a payment-based method, would be detrimental to the Australian economy. This was highlighted by the Productivity Commission of Australia. The demographic dividend from migration would be reduced in a payment-based system. The Productivity Commission sees no merit in accepting migrants through a payment-based system.

Australia has been successful in bringing in more working-age adults through the current immigration system. These immigrants are helpful in addressing the labour shortage and filling in skill gaps. The fact that working-age immigrants tend to work for a longer period also brings in economic benefit to the Australian economy.

Most of these working-age migrants hold jobs and pay their taxes. They also tend to use Medicare less, which is Australia’s national health scheme. This also helps boost the Australian economy.

BC PNP in Canada issues 242 invitations in its latest draw

In its latest draw held on 26th March, the British Columbia Provincial Nominee Program issued 242 invitations. These invitations were issued to candidates in the Express Entry and Skills Immigration BC streams.

The BC Express Entry Stream nominates candidates who have an active profile in the Federal EE Pool. Nominated candidates receive an additional 600 points on their CRS scores.

Below are the categories available under the Skills Immigration Stream:

  • Skilled Worker
  • International Graduate
  • Entry Level and Semi-Skilled

The Skills Immigration Stream is not aligned with the Express Entry system.

Candidates who are nominated under the Skills Immigration Stream need to submit their applications for Permanent Residence to IRCC.

All invited candidates had to first complete their registration on the BC PNP SIRS (Skills Immigration Registration System). These candidates are then given their registration score.

SIRS is a point-based system which is used to evaluate registered candidates. Candidates are evaluated on the basis of their education, work experience, and language proficiency skills.

Candidates who received an invitation on 26th March will need to provide evidence of having a full-time job offer in British Columbia.

23 invitations were also issued in the 26th March draw under the BC Entrepreneur Immigration Scheme, as per CIC News.
